Terms of Service

BM Security LLC ("we," "us," "our") operates blackmagick.io (the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.


1. Service

BlackMagick provides educational content and code for authorized security research and red team work—techniques, tutorials, and reference materials. Content is dual-use; your use must be lawful and authorized at all times.

2. Eligibility

You must be 18+ (or age of majority), provide accurate information, and not be restricted from use (e.g., not in a sanctioned jurisdiction, not personally sanctioned by UN/US/UK/EU, not re-exporting to prohibited persons). We may refuse or revoke access at our discretion.

3. Acceptable Use

Use the Service only for lawful purposes: authorized security research, pentesting with written authorization, education in controlled environments, or defensive research where authorized. Do not: access systems without authorization, violate laws (including CFAA, export controls), deploy malware without authorization, harm others, circumvent safeguards, or resell/redistribute in violation of these Terms. Violation may result in immediate termination without refund and reporting to authorities.

4. Payment & Refunds

Subscriptions are billed in advance via Stripe. Cancel anytime; access continues until the end of your billing period. No refunds. We may change prices with notice; continued use constitutes acceptance.

5. Intellectual Property

We own the Service and its content. We grant you a limited, revocable right to access and use it solely for lawful purposes under Section 3. Downloadable code may have a file-level license (e.g., MIT) that applies only to lawful use. No copying, scraping, or bulk-downloading beyond normal use.

6. Privacy

Your use is governed by our Privacy Policy. By using the Service, you consent to those practices.

6.1 Email address and account identifiers

What we collect. When you sign in with a third party (e.g. Google, GitHub, Discord, or X), we receive the email address that provider makes available to us for that login, along with identifiers the provider supplies (such as provider user id), and, when offered, your display name and profile image URL. If you subscribe or pay through Stripe, we also process billing-related data Stripe shares with us (e.g. customer id, subscription status) as needed to provide paid access.

Why we collect it. We use this information to create and secure your account, authenticate you, link your subscription and payments to the correct user, communicate with you about the Service (e.g. account, billing, security), enforce these Terms and prevent abuse or fraud, and comply with legal obligations.

How we use it. We do not sell your email address. We use it and related account data only to operate and improve the Service, process payments, respond to requests, and protect users and the platform. We may send operational or transactional messages (e.g. receipts, security notices) where appropriate.

Retention. We retain account and related information for as long as your account is active and as needed thereafter for legal, tax, fraud-prevention, and legitimate business purposes, then delete or anonymize it consistent with our records practices.

7. Disclaimers & Liability

The Service is provided "AS IS" for educational purposes. We do not warrant uninterrupted or error-free service. You are solely responsible for ensuring your use is lawful and authorized. We are not liable for misuse. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM (OR $100). Some jurisdictions do not allow these limitations; they may not apply to you.

8. Termination

You may cancel anytime. We may suspend or terminate your account at any time for breach, prohibited use, or any other reason. Upon termination, access ceases immediately; no refund for breach. Key sections (3, 5, 7, 9, 10) survive termination.

9. Disputes

These Terms are governed by Tennessee law. Before arbitration or litigation, give us 30 days' written notice at [email protected] to resolve informally. Disputes are resolved by binding JAMS arbitration in Tennessee. You waive jury trial and class/collective/representative actions. You may opt out of arbitration by emailing [email protected] within 30 days of first use (include name, email, "opt out"). Small-claims court and injunctive relief for IP infringement remain available. Venue: Tennessee courts. One-year limitations period. If arbitration/class waiver is invalid, Tennessee courts have exclusive jurisdiction.

10. General

You indemnify us against claims arising from your use, breach, or violation of law. These Terms with our Privacy Policy constitute the entire agreement. Severability, no waiver by non-enforcement, no assignment without our consent. We may assign freely.
